Terms of Use for Fitxome

Welcome to Fitxome. These Terms of Use ("Terms") govern your access to and use of the Fitxome mobile application and related services.

By downloading, accessing, or using Fitxome, you agree to be bound by these Terms. If you do not agree, do not use the app.

1. Use of the App

Fitxome is a fitness and wellness app designed to help users follow exercise routines, track activity, log weight, estimate calories burned, calculate BMI, and use route tracking and map features.

You agree to use Fitxome only for lawful purposes and in accordance with these Terms.

2. Not Medical Advice

Fitxome is not a medical device and does not provide medical advice. The workouts, routines, recommendations, calorie estimates, BMI calculations, tracking features, and other content in the app are provided for general fitness, wellness, and informational purposes only.

Fitxome does not diagnose, treat, cure, or prevent any disease, condition, or injury.

Always consult a qualified physician or other licensed healthcare professional before starting any exercise program, especially if you have a medical condition, injury, pain, dizziness, or any concern about your physical condition.

3. Assumption of Risk

Exercise and physical activity involve inherent risks. By using Fitxome, you acknowledge and agree that you voluntarily participate in workouts, strength exercises, resistance exercises, bodyweight exercises, chair-based exercises, walking, jogging, running, and route-based activities at your own risk.

You are solely responsible for determining whether any exercise or activity is appropriate for you.

Possible risks include, without limitation:

  • Falls
  • Slips
  • Trips
  • Collisions
  • Muscle strain
  • Joint pain
  • Overexertion
  • Aggravation of existing conditions
  • Other physical injury, illness, or complications

If you feel pain, weakness, dizziness, shortness of breath, or discomfort, stop immediately and seek medical attention if appropriate.

You acknowledge that you use Fitxome and participate in all activities entirely at your own risk.

4. User Responsibility

You are responsible for:

  • Using proper judgment during any workout or activity
  • Exercising in a safe environment
  • Using stable and appropriate surfaces, furniture, or equipment
  • Monitoring your own physical condition
  • Following outdoor and traffic safety rules when walking, jogging, or running
  • Deciding whether an activity is safe for you

Fitxome does not supervise your activity and cannot evaluate your health, environment, technique, or surroundings.

5. No Guarantee of Results

Fitxome does not guarantee any specific health, fitness, weight loss, calorie, performance, or body composition result. Individual results vary.

6. Tracking, Metrics, and Estimates

Fitxome may display estimates, calculations, and activity metrics, including repetitions, sets, calories burned, BMI, steps, distance, and routes.

These values may not always be accurate and should not be relied on as medical, health, or professional measurements.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Fitxome and its owners, developers, affiliates, licensors, and service providers shall not be liable for any injury, loss, claim, damage, or any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to:

  • Your use of or inability to use the app
  • Any workout, exercise, or physical activity performed in connection with the app
  • Any fall, collision, strain, injury, illness, or medical event
  • Outdoor activity such as walking, jogging, running, or route tracking
  • Inaccurate or incomplete metrics, recommendations, or estimates
  • Device, GPS, sensor, mapping, or software errors
  • User-provided information or incorrect inputs

If applicable law does not allow certain limitations, some of the above limitations may not apply to you.

8. Privacy

Your use of Fitxome is also governed by our Privacy Policy.

9. Eligibility

Fitxome is intended for users who are at least 13 years old.

10. Changes to the App or Terms

We may modify, suspend, or discontinue any part of Fitxome at any time. We may also update these Terms from time to time by updating the Effective Date above or through the app.
